Question : I live in albany ny and I wanted to know if my landlord can charge me to clean the carpets before I move?
I am moving to a new home and I was told that the landlord can not charge me to clean the carpets because it is normal wear and tear and would be his responsibility to clean. Is that true?

Wear and tear refers to that which is sustained during everyday use. For instance, wear patches or tracking marks on the areas of carpet which receive heaviest traffic; dent marks from furniture; fibre matting to ‘in-use’ areas. It also depends how old the carpets are and how long you’ve been in the property. If this is a 5 plus-year-old carpet that wasn’t particularly clean when you moved in and you’ve been a tenant for several years, then your landlord can’t claim it as your responsibilty to clean or replace. If the carpets have become stained and dirty however (and weren’t when you moved in) or the landlord can prove they were newly fitted shortly before you signed the tenancy, that is not normal wear and tear.
