Is a buck knife considered a switchblade?
My buck knife flips open, but only when you push it into an open position. There is no button that makes it fly open, but it can be opened by using enough force.
I just want to make sure that it isn’t illegal according to the California state code.

Do not worry. If you ever held or used a real switchblade there would be absolutly no confusion – they have a very powerful spring that literally ‘jumps’ the blade into position.
The only reason switchblades are illeagal – you can thank Hollywood and all the B movies of the 1950′s and 1960′s.
Switchblades are actually very, very useful – especially for climbers, divers, and emergency medical technicians at accidents. They are legal for police and military. You would be surprised at how many people actually carry them – they just don’t take them out and play with them in public.

There is a provision in California law that says a folding knife is illegal if it can be opened with only a flick of the wrist; but it is meant to apply to butterfly/balisong knives. A knife that opens due to manipulation of the blade is, by definition NOT a switchblade (in California–can’t speak for anywhere else). By the way, it is not illegal to own a switchblade in California, it is only illegal to carry them if they have a blade length of 2 inches or more. Where you get into trouble is shipping a switchblade across state lines–that’s a violation of federal law. Now for the disclaimer–I am not an attorney and this should not be construed legal advise, just a knife fancier who is relating information I believe to be accurate.

No. This is called “Assisted Opening.”
Some people want to outlaw it, but it is not illegal yet.
If it becomes so then those of us who already have them will probably be grandfathered in. I hope.
Clarification: It is not ‘Federally’ illegal.
I am not aware of specific California statutes on ast, but they are definately not classified as a switchblade anywhere. Honest Melungeon.
